Terms of service

1. Overview

This website, wichitafallsequipment.com, is operated by Wichita Falls Equipment (“we,” “us,” “our”), 5628 State Highway 79 S, Wichita Falls, TX 76310. These Terms of Service apply to anyone who visits the site, contacts us through it, or buys from us, whether the sale starts online, by phone, by invoice or in person at our yard. By using the site or buying from us, you agree to these terms. If you do not agree, please do not use the site or place an order.

These terms work together with our Return Policy & Warranty and our Privacy Policy, which are part of these terms by reference.

2. Who Can Buy

You must be at least 18 years old and able to enter a binding contract to buy from us. You agree to give us accurate name, contact, billing and tax-exemption information and to keep it current until your purchase is complete.

3. Product Information

We work hard to describe every unit accurately. Specifications such as horsepower, weight, dig depth, payload and hydraulic flow often come from the manufacturer and are provided as a guide. Photos may show a similar unit, optional equipment or a different color. If a detail matters to your decision, ask us or come inspect the unit before you buy — we encourage it.

You are responsible for confirming that an attachment fits and is rated for your machine, including mount type, hydraulic flow and pressure, and lift capacity. We are glad to help you check, and you are welcome to bring your machine to test fit.

4. Prices, Promotions and Taxes

  • Listed price. Prices on this site are the listed price, which is what financing and other non-cash payment methods are charged. Where a cash price or cash discount is shown, it applies only to payment by cash or verified cashier’s check.
  • Sales and promotions. Sale prices apply only during the stated sale period and only to the units named. Promotions cannot be combined with other discounts unless we say so in writing. Where a sale price is shown, the discount is already included in the price displayed.
  • Card payments. Credit and debit card payments are taken by manual invoice, and a processing fee applies as stated in our Payment & Fees terms.
  • Order-in items. Items marked “Not Stocked On Site” are priced from current supplier cost, which can change before we place your order. We will confirm the final price with you before ordering.
  • Errors. If a price or description is posted in error, we may correct it and cancel or refuse any order placed at the incorrect price, even after it has been confirmed. If you have already paid, we will refund you in full.
  • Sales tax. Prices do not include sales tax. Tax is added unless you provide a valid Texas agricultural (AG) or resale exemption certificate at or before the time of purchase. We cannot refund tax after a sale is complete.

5. Payment and Deposits

We accept cash, verified cashier’s checks, invoices issued through Square from wichitafallsequipment.com, and the financing options shown on our site. We do not accept Zelle, Cash App or similar peer-to-peer payment apps, and we will never ask you to pay that way. If anyone asks you to pay us through one of those apps, it is not us — call us at (940) 400-0305.

Cashier’s checks are verified with the issuing bank before equipment leaves our lot. A deposit holds a unit for you and is applied to the purchase price. Whether a deposit is refundable, and the date by which the balance is due, will be stated on your invoice. A unit is not reserved until we confirm your deposit has been received.

6. Financing

Financing is provided by independent third parties, including Mower Finance (powered by Terrace Finance), Synchrony and Affirm. We are not a lender. Applications, approvals, approval amounts and terms are decided solely by the provider under its own agreement with you, and approval is not guaranteed. Questions about a financing agreement should go to the provider.

7. Orders

Your order is an offer to buy. It is accepted when we confirm it and receive payment or an agreed deposit. We may decline or cancel any order, including for suspected fraud, unavailable stock, a pricing or description error, or an inability to verify payment. If we cancel after you have paid, we will refund what you paid.

8. Pickup, Delivery, Title and Risk

  • Sales and pickups are by appointment at our Wichita Falls, TX yard. We can help load onto your trailer, but you are responsible for having a trailer and tow vehicle rated for the load and for securing it before you leave.
  • Delivery is available on some items for an additional fee, quoted before you buy.
  • Inspect before you leave. Report missing parts, shortages or damage before the equipment leaves our yard, or note it on the delivery paperwork at delivery. We cannot accept claims for damage once equipment has left our yard.
  • Title passes to you when we receive payment in full. Risk of loss passes to you when the equipment is picked up by you or your hauler, or delivered to you.
  • Please pick up paid units by the date we agree on. If a unit is left past that date, we may charge reasonable storage, which we will tell you about first.

9. Returns and Warranties

Returns are handled under our Return Policy & Warranty. Where a manufacturer provides a warranty, it comes from the manufacturer, not from us, and claims are handled with the manufacturer.

EXCEPT FOR ANY WARRANTY A MANUFACTURER PROVIDES DIRECTLY, ALL EQUIPMENT, ATTACHMENTS, SHIPPING CONTAINERS AND OTHER ITEMS ARE SOLD “AS IS, WHERE IS,” WITH ALL FAULTS. TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

10. Safe Operation

Excavators, skid steers, dumpers and attachments are heavy machinery that can cause serious injury, death or property damage if misused. You agree to read and follow the operator’s manual and safety labels, use proper protective equipment, keep bystanders clear, operate only within rated capacities, and follow all laws that apply to you. Call 811 before you dig. You are responsible for anyone you allow to operate equipment you buy from us.

11. Limitation of Liability

TO THE FULLEST EXTENT ALLOWED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST USE, DOWNTIME OR RENTAL COSTS, ARISING FROM YOUR USE OF THIS SITE OR ANY ITEM WE SELL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO A PURCHASE WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE ITEM INVOLVED. Nothing in these terms limits liability that cannot be limited under applicable law.

12. Indemnity

You agree to defend and hold us harmless from claims, losses and expenses, including reasonable attorney’s fees, arising from your use, transport or operation of equipment bought from us, or from your breach of these terms, except to the extent caused by our own negligence.

13. Using This Website

The text, photos, logos and design on this site belong to us or our suppliers and may not be copied for commercial use without our permission. You agree not to misuse the site, including by attempting to disrupt it, scrape it in bulk, or submit false information. The site may link to third-party websites, such as financing providers, which have their own terms and which we do not control. We may change or discontinue any part of the site at any time.

14. Governing Law

These terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute arising from these terms or a purchase will be brought in the state or federal courts located in Wichita County, Texas, and you agree to the jurisdiction of those courts.

15. General

If any part of these terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. A signed invoice or written agreement for a specific purchase controls over these terms where the two conflict. We may update these terms by posting a new version here with a new “Last updated” date; the version in effect when you placed your order applies to that order.
